A resident of Sharur district, Elshan Musa oglu Zakharov, born in 1972, who worked as a dentist at the "EMV Dent" clinic operating in Baku, introduced himself to his patient as the owner of the clinic and seized a large sum of money from him.
Modern.az reports that he established close relations with Tahir Ahmadagha oglu Huseynov, whose teeth he was treating, during the treatment period. He gained Huseynov's trust and gave him false information that they would earn good profits if they jointly invested in the purchase of implants, X-ray, and "Scanner Catcam" devices.
After convincing the victim, on November 29, 2023, in his service room at the "EMV Dent" clinic where he worked, he received a total of 151,000 manats from Tahir Huseynov under this pretext and embezzled it.
The investigative p announced charges against Elshan Zakharov under Article 178.2.3 of the Criminal Code (fraud causing significant damage).
In court, E. Zakharov pleaded not guilty to the charges. He stated that these events happened to him because others also deceived him:
"They told me that since sanctions were imposed on Russia, implants could be sold faster in that country. Therefore, I sent all the goods to that country, and after a while, when I inquired, I saw that they had disappeared. I found those individuals, and when I went to them, arguments arose, and during the fight, they hit and broke my kneecap. The victim was not aware that I sent the implants to Russian territory."
The statement given by the accused during the preliminary investigation was disclosed in court.
In that statement, the defendant confirmed that he had received 151,000 manats from Tahir:
"I took all the money in my office at the "EMV dent" clinic, located opposite "Metropark" in Narimanov district. My goal was to buy and sell implants, earn a profit, and split it equally with Tahir."
The victim also noted in court that they had agreed with Elshan to split the profit for each implant...
By the verdict of the Baku Court for Grave Crimes, Elshan Zakharov was sentenced to 6 years and 6 months of imprisonment.
The civil claim of the victim was partially satisfied. It was decided that 151,000 manats in material damage and 444 manats in state duty should be recovered from the civil defendant and paid to the victim. He had filed a civil claim for 154,000 manats against the accused.
The appeals of the victim and the defendant were not satisfied.
It should be noted that Elshan Zakharov was also active on social networks as a dentist. In his posts, he provided information about the creation of the first painless, incision-free, bloodless, and most importantly, implant teeth that can also be performed on diabetic patients in Azerbaijan.
Furthermore, promotional materials about his ability to perform painless, bloodless implantation in 3 minutes were also disseminated on social networks. (Teleqraf)
