Azerbaijani legislation reflects the conditions under which military personnel are entitled to a pension based on their years of service.

According to **Modern.az**, a group of military personnel are entitled to a pension based on their years of service.

Thus, the following are entitled to a pension based on their years of service:

  • military personnel who have served 20 calendar years or more in military service or in agencies until their discharge from service;
  • persons discharged from service due to age, who have a total work experience of 25 calendar years or more, with at least 12 years and 6 months of this experience spent in military service or in agencies;
  • persons discharged from service due to illness or limited health capabilities, as well as due to staff reduction, who on the day of discharge are 45 years old, have a total work experience of 25 calendar years or more, with at least 12 years and 6 months of this experience spent in military service or in agencies;
  • military personnel who have 15 years of work experience in military service or in agencies and participated in the elimination of the consequences of the accident at the Chernobyl NPP in the evacuation zone.

Pensions for years of service are determined in the following amounts:

  • for military personnel who have served 20 years or more, **50 percent** of the relevant allowance for 20 years of service, and for those discharged from military service due to age or illness, deemed unfit for military service by military medical commissions, **55 percent**; for each year of service exceeding 20 years, **3 percent** of the relevant allowance;
  • for persons discharged from service due to age, who have a total work experience of 25 calendar years or more, with at least 12 years and 6 months of this experience spent in military service or in agencies, **50 percent** of the relevant allowance and **1 percent** of the relevant allowance for each year of service exceeding 25 years;
  • for persons discharged from service due to illness or limited health capabilities, as well as due to staff reduction, who on the day of discharge are 45 years old, have a total work experience of 25 calendar years or more, with at least 12 years and 6 months of this experience spent in military service or in agencies, **55 percent** of the relevant allowance and **1 percent** of the relevant allowance for each year of service exceeding 25 years;
  • for military personnel who have 15 years of work experience in military service or in agencies and participated in the elimination of the consequences of the accident at the Chernobyl NPP, **50 percent** of the relevant allowance and **3 percent** of the relevant allowance for each year of service exceeding 15 years.

The maximum amount of pensions calculated in the manner specified above cannot exceed the allowance taken as the basis for determining the pension.

The minimum amount of pension for 20 years or more of military service or service in agencies is set at **150 percent** of the minimum wage determined by Azerbaijani legislation.

The following allowances are calculated in addition to the pensions of military personnel for years of service (including pensions calculated at the minimum amount):

  • for non-working pensioners who have disabled family members eligible for a survivor's pension, **50 percent** of the minimum old-age pension amount as defined in the Law “On Pension Provision for Citizens” for each disabled family member (in this case, the allowance is calculated only for family members who do not receive a labor pension or social pension); if a disabled family member has the right to receive both a social pension and an allowance for years of service, a social pension may be assigned to the family member at the pensioner's request, or an allowance for the pension may be calculated for that family member;
  • for lonely pensioners who have reached 75 years of age, **50 percent** of the minimum old-age pension amount for their care;
  • for war invalids and participants:
    - for Group I invalids, **300 percent** of the minimum old-age pension amount,
    - for Group II invalids, **250 percent** of the minimum old-age pension amount,
    - for Group III invalids, **150 percent** of the minimum old-age pension amount; (the three types of allowances mentioned above can be calculated simultaneously)
  • for war participants from among military personnel who served in the active army, in partisan detachments, and participated in combat operations related to the fulfillment of internationalist duty, **100 percent** of the minimum old-age pension amount.

In accordance with the Law “On Pension Provision for Military Personnel”, the procedure for calculating years of service for the assignment of pensions to military personnel is determined by the relevant executive authority.

One year of service for military personnel participating in combat operations in combat conditions is calculated as two years of service. The calculation of one year of service as two years of service for military personnel participating in combat operations in combat conditions is carried out based on the decision of the relevant executive authority. In this case, the duration of the combat conditions must be indicated in that decision. (Trend.az)
