The court case between designer Aleksandra Salamakhina and the company "Gavalı" in Azerbaijan resulted in the designer winning the case. It was previously revealed that the company had unauthorizedly used a post belonging to Aleksandra, which was published on the "Pinterest" website, for the packaging of its products.
The Baku Court of Appeal ensured the payment of 5,000 manats in compensation to Aleksandra Salamakhina.
It was reported to Modern.az by the "Gavalı" company that the company took the design sample from a publicly accessible resource where the author was not indicated.
Human rights defender Ramil Suleymanov stated in his declaration to Modern.az regarding the issue that if any post is placed on internet resources, it is possible to identify the author:
"Especially if it is a personal page, more precise information about the author can be found. The copyright protection mark is also about this."
The lawyer noted that in any case, if a person uses another person's post without permission or attribution, the information owner is granted the right to dispute the matter:
"This case serves as a basis for initiating a criminal case under Article 165 of the Criminal Code of the Republic of Azerbaijan through a private prosecution procedure. In addition to financial sanctions, a penalty of 320 to 480 hours of community service is stipulated as punishment. If the illegal act occurs continuously or in a group, deprivation of liberty for up to 2 years is stipulated under Article 165.2 of the Code."
Ramil Suleymanov added that although the financial fine is set between 1000 and 2000 manats, this amount may change depending on the expert opinion and the extent of the damage incurred.
Designer Aleksandra Salamakhina did not wish to comment on the topic.
