A new norm has been established regarding deductions from an employee's salary in connection with alimony.
Modern.az reports that this is reflected in the amendment to the Labor Code, on the implementation of which President Ilham Aliyev signed a Decree.
According to the Labor Code, the total amount of all deductions made each time salary is paid cannot exceed twenty percent of the salary payable to the employee, and in cases stipulated by relevant legislation, fifty percent. When amounts are deducted from salary based on several enforcement documents, in all cases, fifty percent of the employee's salary must be retained.
The established limitations do not apply to deductions from the salary paid to the employee when performing correctional labor, as well as for the collection of alimony, compensation for damage to health, compensation for damage caused to persons who suffered as a result of the loss of the breadwinner, and compensation for damage caused by a crime.
According to the amendment, in the latter cases, the amount of deductions cannot exceed 70 percent of the salary payable to the employee. In other words, when performing correctional labor, as well as for the collection of alimony, compensation for damage to health, compensation for damage caused to persons who suffered as a result of the loss of the breadwinner, and compensation for damage caused by a crime, the amount of deductions cannot exceed 70 percent of the salary payable to the employee.
