Electronic cigarettes were banned | Modern.az

The import, export, production, storage, wholesale and retail sale, and use of electronic cigarettes and their components are prohibited.

According to Modern.az, this is reflected in the amendment to the Law “On Tobacco and Tobacco Products” approved by President Ilham Aliyev.

According to the Law, nicotine-containing electronic cigarettes are included in the definition of tobacco products. An electronic cigarette is a product intended for the inhalation of vapor, with or without nicotine, into the human p, excluding food products, tobacco products, medicinal products, and medical devices, and intended for use via a device with or without a mouthpiece or other components, including a cartridge and a vial. The vial of electronic cigarettes can be used once or multiple times, or they can be refilled with disposable cartridges.

Heated tobacco products will not be considered electronic cigarettes. A heated tobacco product is a product consisting of tobacco (tobacco mixture) and non-tobacco components used in its production, intended for the inhalation of nicotine-containing aerosol, generated during the heating process without combustion and without the formation of tobacco smoke, into the human p.

Thus, the circulation of nicotine-containing electronic cigarettes is prohibited and they are classified as tobacco products. The clarification of concepts and the definition of new concepts will enable more precise classification and differentiation of tobacco products, including heated tobacco products, as well as electronic cigarettes, in legal enforcement.

At the same time, within the framework of harmonization, relevant amendments are being made to the Tax Code of the Republic of Azerbaijan and the Law “On Advertising” of the Republic of Azerbaijan. This includes the removal of “disposable electronic cigarettes” and “liquids for electronic cigarettes” from the list of excisable goods and the consequent abolition of tax rates, as well as the adaptation of the advertising ban to the new concepts.

This Law comes into force on April 1, 2026.
