"The Constitutional Court has adopted an important decision regarding the payment of additional compensations to employees. According to the decision, when an employment contract is terminated, the employee will be paid compensation for all unused vacation days from all working years".
Modern.az reports that MP Vugar Bayramov provided information about this in a post on his social media account.
He stated that with this decision, for the additional vacations specified in Articles 115-117 and 118-1 of the Labor Code, the payment of compensation calculated in the manner and amount determined for unused basic labor leave will be ensured:
"Article 115 determines the durations of additional leaves based on working conditions and the specifics of the labor function, Article 117 determines additional leaves for women with children, and Article 118 determines the durations of labor leaves for employees engaged in pedagogical and scientific activities.
Thus, if an employee has not fully utilized additional or basic leave for various reasons, then upon termination of employment, they will be paid compensation for those days. In this case, payment for unused additional leaves is envisaged for both those working in underground jobs, employees whose working conditions are harmful and arduous, as well as those whose labor function involves high sensitivity, anxiety, mental and physical strain, and who have additional leaves due to working conditions and the specifics of their labor function, and also for women with children".
"If an employee has 50 days of unused additional leave and 40 days of unused basic leave during their employment period, then upon termination of employment, they will be paid an additional 90 days of leave compensation. If the daily leave payment is 50 manats, then the employee will be provided with an additional compensation payment of 4,500 manats.
This decision will serve to better protect the social rights of employees and eliminate inequality in compensation payments", - V. Bayramov noted.
