Changes have been made to the rules for the compulsory collection of fines in Azerbaijan.
Modern.az reports that this is reflected in the amendment to the Code of Execution of Punishments approved by President Ilham Aliyev.
According to the law in force until now, if the convict failed to pay the fine within the specified period, the execution of the punishment in the form of a fine was carried out compulsorily by the court that rendered the judgment, in the manner prescribed by the legislation of the Republic of Azerbaijan, i.e., by directing it towards the convict's privately owned property or share in common property. The collection of the fine was directed towards the convict's salary or other earnings only if they had no property, or if this property was insufficient to fully cover the fine.
According to the amendment, if the convict fails to pay the fine within the specified period, the execution of the punishment in the form of a fine will be carried out by the court that rendered the judgment, by directing it to compulsory execution. In this case, the fine will primarily be directed towards the convict's salary or other earnings. If the convict has no salary or other earnings, or if the convict's salary or other earnings are insufficient to fully cover the fine, the fine will be directed towards the convict's privately owned property or share in common property, and in this case, the provisions of the law "On Enforcement" regarding the direction of the claim towards the debtor's property will be applied.
