The scope of exemptions from paying state fees for filing a statement of claim, another application or complaint with the court, and for re-issuing a copy of a court act is being expanded.

Modern.az reports that this issue is reflected in the proposed amendment to the Law “On State Duty” which was discussed at today's meeting of the Milli Majlis.

According to the document, applicants who are victims of domestic violence will also be added to this list for applications regarding the issuance of a long-term protection order to a person who has suffered from domestic violence.

It was stated that the draft law was prepared with the aim of exempting applicants who are victims of domestic violence from paying state fees in connection with filing an application with the court for the issuance of a long-term protection order.

The issuance of a long-term protection order (for a period of 60 to 180 days) to a person who has suffered from domestic violence is applied by the court when there are no signs of a criminal offense in the complaint about domestic violence.

Thus, if a person who has committed domestic violence fails to comply with the warning issued and the requirements of the short-term protection order, the victim, the relevant executive authority, or the prosecutor has the right to apply to the court in a special proceeding for the issuance of a long-term protection order. Currently, according to the Law “On State Duty”, a state fee of 100 manats is set for filing an application in cases considered under special proceedings, and at the same time, budgetary organizations are exempt from these payments for statements of claim, other applications, or complaints submitted to the courts.

Exempting applicants who are victims of domestic violence from state fees for filing an application with the court in connection with the issuance of a long-term protection order is aimed at increasing their access to court.

A person who has suffered from domestic violence refers to a person who has suffered physical or moral harm as a result of intentional physical, psychological, sexual violence, or illegal actions of an economic nature committed by one of the persons specified in the Law “On the Prevention of Domestic Violence” against another on domestic grounds.

After discussions, the issue was put to a vote and adopted in the third reading.
