It is proposed to add new grounds to the legislation regarding the protection of the rights and interests of children deprived of parental care.
According to Modern.az, this was discussed today at a joint meeting of the parliamentary Committee on Human Rights and Family, Women and Children Affairs.
The proposed amendment specifically outlines cases where the rights and interests of children are protected by the state when parents are unknown, declared missing by a court without notice, or declared deceased.
Furthermore, it is proposed to add to the list cases where parents are unable to exercise their parental duties due to illness, disability, or mental deficiencies. At the same time, parents' refusal to raise children or protect their rights and interests, and their refusal to take children from social service institutions, are also considered as cases where parental care is effectively absent.
Another notable point in the amendments is the inclusion of cases where parents are serving sentences in correctional facilities as grounds for children to be taken under state protection.
In these cases, the protection of children's rights and interests will be carried out by the p (institution) determined by the relevant executive authority.
