The vehicle brought to and kept at the parking facility will be returned to its owner immediately after the determined fee is paid.
Modern.az reports that the issue was stated during the discussion of the draft laws “On Road Traffic” and “On Motor Roads” at today's plenary session of the Milli Majlis.
According to the proposed amendment to the law “On Road Traffic”, the impounded vehicle will be returned to its owner immediately after the owner pays the fee, in the amount determined by the p (institution) designated by the relevant executive authority, for the vehicle to be brought to and kept at the protected parking facility determined by the p (institution) designated by the relevant executive authority. If the vehicle was unlawfully impounded or if material damage was caused to it as a result of improper storage, the owner of the vehicle may file a complaint through administrative procedures and with the court.
The fee for keeping a vehicle brought to a protected parking facility will start to be calculated from 00:00 on the day following the day the vehicle was brought to the protected parking facility. If the proceedings regarding the administrative offense that led to the vehicle being taken to the protected parking facility are terminated, or if a complaint filed against the decision to impose an administrative penalty for the offense is upheld, the amount of the fee paid for bringing the vehicle to the parking facility and keeping it there will be returned to the owner of the vehicle in the manner determined by the p (institution) designated by the relevant executive authority.
The issue was put to a vote and adopted in the third reading.
