The list of documents required from drivers for obtaining a permit for domestic ordered passenger and cargo transportation by car is being expanded.
Modern.az reports that the issue was reflected in the draft law “On Motor Transport” discussed at today's plenary session of the Milli Majlis.
The document emphasized that drivers must submit documents regarding the possibility of organizing pre-trip technical inspection and pre-trip medical examination of motor vehicles, or contracts with a technical inspection point and a medical point for the use of relevant services.
Documents confirming that drivers performing transportation by motor vehicles for general use have undergone special training are also required. In relation to irregular passenger transportation, the individual accident insurance of passengers transported by motor vehicle, the civil liability of motor vehicle owners, as well as the relevant compulsory insurance confirming the compulsory insurance of the motor vehicle driver against loss of professional working capacity due to accidents and occupational diseases, are also checked.
The draft law states that, as a continuation of the work carried out, there is a serious need for improvement in the field of domestic ordered transportation, which is a type of motor vehicle transportation (this includes irregular passenger transportation and domestic cargo transportation, with the exception of passenger transportation by taxi cars), especially in the area of permitting this activity. On the one hand, the increasing demand for irregular passenger transportation, and on the other hand, the high incidence of serious road accidents involving these vehicles, make the proposed changes inevitable.
Currently, permission for domestic ordered transportation is carried out by issuing a permit. The requirements (documents) for issuing a permit for domestic ordered transportation are very limited compared to other types of transportation (including taxi activities), and fewer documents are required. The required documents are mainly informational (information about the person receiving the permit, TIN, documents defining rights over the vehicle). The proposed change envisages the establishment of additional requirements (documents) for obtaining a permit, which serve to assess the driver's professionalism (having undergone special training), the suitability of the driving license category for this activity, their health status, and the technical condition of the vehicle. It should be noted that these requirements currently exist when issuing permits for passenger transportation by taxi and regular intra-city, inter-city (inter-district) passenger transportation.
For your information, a large part of the vehicles carrying out ordered transportation has been provided with a permit card recently. Specifically, 3764 permits and 6322 vehicle permit cards have been issued for domestic irregular passenger transportation. For domestic cargo transportation, 14120 permits and 43135 permit cards have been issued. The operating age of vehicles for which permit cards have been issued remains high. Citizens apply for a permit and a permit card through the "E-carrier" subsystem created in the "AYNA" Information system, and the relevant permit is obtained in electronic form.
Considering that the average age of vehicles used in ordered transportation (especially in passenger transportation) is 17.6 years, it is not possible to fully control the safety of these vehicles for transportation merely by their passing a technical inspection. On the other hand, it should be noted that while there are requirements regarding the technical, interior, and exterior design for taxi cars carrying a maximum of 5 passengers, the absence of these requirements in ordered passenger transportation carrying more than 10 passengers can lead to more serious dangers.
At the same time, the draft law will also require the existence of documents confirming the following compulsory insurances for obtaining a permit in relation to irregular passenger transportation, which is a type of domestic ordered transportation, as well as in relation to regular international and inter-city (inter-district) passenger transportation:
individual accident insurance for passengers transported by motor vehicle;
compulsory civil liability insurance of motor vehicle owners; compulsory insurance of the motor vehicle driver against loss of professional working capacity due to accidents and occupational diseases.
It should be noted that these requirements are defined in this Law as the duty of the carrier performing passenger transportation by motor vehicle, and the compulsory nature of these insurances is stipulated in the laws "On Compulsory Insurances" and "On Compulsory Insurance against Loss of Professional Working Capacity due to Accidents and Occupational Diseases in Production," and the mentioned insurances must currently exist during the implementation of these activities. Ensuring the existence of these requirements in advance, i.e., when granting permission, will contribute to these norms being more effective and ultimately to an increased level of compliance with these requirements in daily activities.
Another proposed change relates to the compliance of the technical specifications, interior, and exterior design of motor vehicles performing irregular passenger transportation with the relevant requirements (as in regular and taxi passenger transportation).
Within the framework of the changes, the concept of "carrier" is also clarified.
The draft law serves to increase the level of safety in the transportation of passengers and cargo, to provide quality service, and to create insurance coverage for the protection of insured persons, especially injured passengers, and for damage to their life and health during various insurance events.
The draft law was put to a vote and adopted in the first reading.
