The institution that will identify children in difficult life situations is being determined.
Modern.az reports that this was discussed at today's plenary session of the Milli Majlis.
According to the amendment, children in difficult life situations, unlike adults, have a weaker ability for self-defense and independent appeal, which necessitates the immediate and urgent implementation of measures concerning them upon their identification. Specific responsibilities fall upon the responsible institution in this regard.
Consequently, the inclusion of new norms into the Law "On Social Services" and the Regulations on Commissions for the Protection of Children's Rights is envisaged.
According to the amendment, commissions for the protection of children's rights have been designated as the institution identifying children in difficult life situations (excluding children deprived of parental care).
It was emphasized that the commissions will determine the presence of disability in children, neglect or socially dangerous situation of minors, the inability for self-care due to illness, disability, or old age, as well as the absence of able-bodied relatives or legal representatives who can provide care and assistance to a person (family), and the absence of relatives who can provide care and assistance to persons unable to self-care due to illness, disability, or old age.
At the same time, it was reported that in recent years, based on amendments to family legislation, the powers of the prosecutor's office in the direction of protecting children's rights have been expanded. The prosecutor's office also has the function of procedural control over the ensuring of children's rights in cases concerning criminal and administrative offenses. It is proposed that, alongside relevant state bodies (institutions), the prosecutor also be designated as an institution exercising state control over the implementation of children's rights.
It should be recalled that, according to the newly drafted Law "On Children's Rights", state bodies (institutions) exercising state control over the implementation of children's rights, local self-government bodies, and non-governmental organizations will conduct preventive work with children in difficult life situations and their families, and provide them with assistance.
