State control over transferred administrative fines is being increased, and "ICMAL" will be a subsystem of "Digital State Finance".
Modern.az reports that the issue is reflected in the proposed amendment to the Code of Administrative Offenses, which was discussed at today's plenary session of the Milli Majlis.
According to the draft law, the "ICMAL" information system will be reorganized as the "Central Automated Board of Administrative Fines" subsystem, i.e., the "ICMAL" subsystem, within the "Digital State Finance" information system, and accordingly, amendments will be made to the relevant articles of the Code of Administrative Offenses. This transformation will ensure the integration of data analysis functions for administrative fine revenues and control over the accuracy of such data into a unified state financial platform. The "ICMAL" subsystem will ensure the analysis of data regarding the portion of fines applied under the Code of Administrative Offenses that is calculated and transferred to the state budget and/or the accounts of authorized bodies (institutions) that have adopted a decision (electronic decision) on the application of an administrative penalty in the form of an administrative fine, and the exercise of control over the accuracy of such data.
The project also envisages certain improvements related to the official issuance of documents concerning administrative offenses. According to the project, a copy of the decision on applying an administrative penalty or the protocol on an administrative offense, in paper form, for administrative offenses against traffic rules, road safety, and rules for using motor roads directly detected by an authorized p (official), will be officially issued on the spot by presenting it to the person against whom proceedings are being conducted regarding the administrative offense.
Furthermore, the project proposes that a person who is alleged to have caused moral, physical, or material damage to a person represented by an act provided for by law cannot be a participant in proceedings concerning administrative offenses as the legal representative of that person.
The issue was put to a vote and adopted in the first reading.
