Today, a student shot their teacher at "Idrak" Lyceum. A 10th-grade student shot their 29-year-old teacher with a hunting rifle, injuring them.
Modern.az conducted an investigation regarding the legal aspects of the matter.
Lawyer Ramil Suleymanov, commenting on the incident, stated that Article 20 of the Criminal Code of the Republic of Azerbaijan stipulates that if a person who commits a crime has reached the age of 16, they are subject to criminal liability.
“However, individuals who have reached the age of 14 can also be held liable in cases such as intentional homicide, intentional infliction of grievous bodily harm, and kidnapping. In general, regarding minors, both penalties are imposed and compulsory measures of an educational nature may be applied. In such cases, penalties such as fines, correctional labor, community service, restriction of liberty, or deprivation of liberty for a certain period are stipulated".
The expert stated that in cases resulting in death, the criminal article is aggravated.
"In cases resulting in death, this is considered a crime of homicide, and a criminal case will initially be initiated under Article 120.1 of the Criminal Code of the Republic of Azerbaijan. Subsequently, the act may be reclassified under more aggravating articles. However, since the sanction of this article provides for a penalty of deprivation of liberty, the punishment for the person (here) will not exceed 10 years. As a first-time offender, they may serve their sentence in a general regime correctional institution".
Here, individuals who may also be held liable include the father, who bears direct responsibility for the weapon. Furthermore, employees of the security system of “Idrak” Lyceum will also be involved in the investigation.
