A new authority has been granted to the Cabinet of Ministers of the Nakhchivan Autonomous Republic.
Modern.az reports that this is reflected in the amendment made to the “Rules for Classifying Lands into Categories and Transferring Them from One Category to Another” by a decree of President Ilham Aliyev.
According to the decree, the classification of lands into categories and their transfer from one category to another will be carried out by a decision of the Cabinet of Ministers in agreement with the President of the Republic of Azerbaijan, and in relation to lands in the Nakhchivan Autonomous Republic, by a decision of the Cabinet of Ministers of the Nakhchivan Autonomous Republic. Until now, this authority rested solely with the Cabinet of Ministers.
With the exception of cases where the intended purpose of agricultural lands under cultivation and perennial plantings is changed among themselves within the agricultural land category, the change of the intended purpose of lands within the category will be carried out by a decision of the Cabinet of Ministers, and in relation to lands in the Nakhchivan Autonomous Republic, by a decision of the Cabinet of Ministers of the Nakhchivan Autonomous Republic.
Furthermore, according to the decree, the change of category for lands where non-residential construction objects, permitted for operation based on applications made until January 1, 2026, are located, will be carried out in accordance with the said Decree. Until now, this period was set until January 1, 2025.
A decision on changing the category of a land plot is made based on the petition submitted in the manner established by the said Decree and the land management plan of the land plot where the non-residential building (infrastructure object) permitted for operation is located, which is attached to it.
