Azerbaijan had put forward a number of conditions to Armenia for a peace agreement. Almost all of those conditions have been met. Only the amendment to the Armenian Constitution remains.
According to some experts and political commentators, a referendum on the Azerbaijani Constitution should also be held in the near future. This view is mainly justified by the serious problems that may arise in the return of the population to the enclaves and the ensuring of their security. It is noted that the issue of enclaves will sooner or later bring the "territorial exchange" option to the political agenda of both countries.
However, Article 3, Part II, and Article 11, Part III of the current Constitution of Azerbaijan prohibit the Azerbaijani government from "territorial exchange" – changing borders. This issue can only be resolved by a referendum.
In a statement to Modern.az, Razi Nurullayev, a lawyer-deputy of the Milli Majlis, stated that he sees no need for any changes to our Constitution amidst the improvement of Azerbaijan-Armenia relations:
"Because currently, Azerbaijan has no territorial claims against Armenia. Armenia has raised territorial claims against Azerbaijan and occupied our lands. Therefore, based on historical truths and facts, Azerbaijan demands that Armenia change its Constitution. For this reason, I see no need for the Azerbaijani Constitution to be changed."
R. Nurullayev emphasized that a final peace agreement can only be signed after amendments are made to the Armenian Constitution based on Azerbaijan's rightful demands:
"I do not think that Armenia can demand a constitutional change from Azerbaijan. Even if Armenia had such a demand, Azerbaijan would not yield to it. On the contrary, today Azerbaijan is putting forward demands to Armenia. And they are fulfilling our demands. Demands regarding this have been put forward informally by Armenians. But such an idea has not been voiced officially, nor can it be. I believe that a final peace agreement can only be signed after amendments are made to the Armenian Constitution based on Azerbaijan's rightful demands."
