Those who violate the legislation on private enforcement officers will be fined.

According to Modern.az, this is reflected in the new Article 528-3 proposed to the Code of Administrative Offenses, which was discussed at today's joint meeting of the Legal Policy and State Building, and Human Rights Committees of the Milli Majlis (National Assembly), held in a videoconference format.

According to the draft, a person who has not taken an oath in accordance with the law "On Private Enforcement Officers" and whose information is not included in the Register of Private Enforcement Officers will be fined one thousand five hundred manats for engaging in private enforcement officer activities. For illegally wearing the uniform and/or insignia of a private enforcement officer, a fine ranging from five hundred to seven hundred manats will be imposed, with the uniform and special insignia that were the object of the administrative offense being confiscated. For failure by private enforcement officers to inform the registering authority about changes in the information contained in the Register of Private Enforcement Officers within 3 (three) working days, a fine of five hundred manats will be applied.

For commencing activity as an assistant to a private enforcement officer without their information being included in the Register of Private Enforcement Officers, a warning will be issued or a fine of five hundred manats will be imposed. For an assistant to a private enforcement officer independently engaging in private enforcement officer activities or carrying out enforcement actions, a fine of one thousand five hundred manats will be imposed.

For interfering with the lawful activities of a private enforcement officer related to the execution of enforcement documents, individuals will be fined an amount ranging from two hundred to three hundred manats, officials an amount ranging from four hundred to six hundred manats, and legal entities an amount ranging from eight hundred to one thousand two hundred manats.

For private enforcement officers obtaining unnecessary information from state and other information resources and systems in connection with the execution of enforcement actions, a fine ranging from five hundred to one thousand manats will be imposed.

These will be applied if the aforementioned actions do not lead to criminal liability under the relevant articles of the Criminal Code.
