Court disputes related to credit agreements HAVE INCREASED

In 2025, disputes arising from contractual relations constituted the majority of civil cases heard by the Commercial Collegium of the Supreme Court in Azerbaijan.

According to Modern.az, this was reflected in the Supreme Court's activity report for 2025.

According to the report, a total of 614 cases were heard by the Commercial Collegium last year, which represents an increase compared to 2024 (542 cases in 2024). The main part of the cases consisted of disputes arising from contractual relations. Specifically, 418 cases were registered in this category, accounting for 68.1 percent of the total cases. In 2024, this indicator was 366 cases or 68 percent.

Among contractual disputes, the highest increase was observed in credit agreements. The number of cases in this area rose from 111 to 151. At the same time, disputes over lease agreements also increased from 46 to 61. In contrast, disputes over sale and purchase agreements decreased from 107 to 102, and those over contract agreements fell from 40 to 29. An increase was also recorded in disputes arising from other agreements, rising from 32 to 40.

In other categories, disputes related to property rights increased from 27 to 29, and disputes arising from land relations rose from 8 to 12. The number of corporate disputes remained unchanged at 18. Conversely, disputes involving natural monopoly entities decreased from 33 to 20. Commercial disputes, however, increased from 54 to 73. 

The report notes that, unlike in 2024, disputes related to bankruptcy were recorded in 2025, and a total of 3 cases were heard in this area. 1 of the reviewed cases was annulled. Additionally, the number of cases heard under special proceedings also increased from 35 to 39.

Overall, within the framework of the Commercial Collegium in 2025, 111 decisions were annulled for cases heard, which constitutes 18 percent of all cases.
