A number of new requirements and restrictions are being established in labor relations concerning individuals with narcological diseases.
According to information from Modern.az, the issue is reflected in the draft law on amendments to the Labor Code and the law “On Narcological Service and Control”, which was discussed at today's meeting of the Milli Majlis Committee on Labor and Social Policy.
According to the draft, during employment in areas where restrictions are envisaged for types of activities and positions, employees must submit an opinion on medical examination (check-up) issued by a state narcological medical institution. Without this opinion, the employment of such individuals in relevant professions and positions is prohibited.
At the same time, based on the provisions added to the law, the grounds for termination of employment contracts with individuals suffering from narcological diseases are expanded. Thus, an employment contract may be terminated if a person is determined to have a narcological disease as a result of a medical examination, or if it is discovered that such individuals have been employed in professions and positions where activity restrictions apply.
Furthermore, the conclusion of an employment contract with individuals who do not have a medical certificate in heavy, harmful, and dangerous working conditions that negatively affect the employee's health, as well as in the food industry, public catering, healthcare, trade, and other similar fields for the purpose of protecting public health, is also defined as a ground for termination.
