Starting tomorrow, a new rule will be applied regarding the payment of maternity benefits.
According to Modern.az, in accordance with the relevant rules, maternity benefits are automatically paid for the calendar days falling within the leave period after the employer enters the maternity leave order into the "Labor and Employment" subsystem of the Centralized Electronic Information System of the Ministry of Labor and Social Protection of the Population of the Republic of Azerbaijan, based on a sick leave certificate prepared in electronic document form by a medical institution.
The right to receive maternity benefits applies to individuals with at least 6 months of social insurance experience. The total amount of the benefit is calculated by multiplying the daily benefit amount by the number of calendar days during the maternity leave period. The monthly maximum amount of this benefit cannot exceed 25 times the minimum amount of the labor pension.
The calculation of the benefit is determined by taking into account the insured's total earnings and the calendar days for the consecutive 4 quarters preceding the month of maternity leave.
When determining the dividing calendar days, periods for which temporary disability benefits were paid or not paid due to social insurance experience being less than 6 months, maternity benefits were paid or not paid due to insufficient experience, as well as the period of partially paid social leave, are excluded from the total calendar days.
In cases where automated assignment is not possible, the payment of benefits is ensured after the employer applies in accordance with Annex 1 of the "Rules for the Assignment, Calculation, and Payment of Benefits for Compulsory State Social Insurance and Benefits Paid at the Expense of the Insurer to Insured Persons Who Have Temporarily Lost Their Work Capacity."
Thus, the new rule will be applied from May 1, 2026. Payments for social insurance events that occurred before this date or continue after this date are carried out in accordance with the norms in force on that date.
